Terms of Service
The short version: be kind, keep it family friendly, and have fun.
Agreeing to these terms
BracketTap (brackettap.com) is operated by Oso Innovative, LLC ("we", "us", "our"). These terms are an agreement between you and Oso Innovative, LLC, and apply when you use BracketTap, including creating, sharing, hosting, streaming or voting in brackets. By using BracketTap you agree to them and to our Privacy Policy. If you don't agree, please don't use the site.
Who can use BracketTap
You must be at least 13 years old, or have a parent or guardian use BracketTap with you. If you use BracketTap for a business, group or stream, you agree to these terms on its behalf too.
The service
BracketTap is free and needs no account. You can play brackets on your own, share them as links, or run rooms where others vote from their phones. We may change, add or remove features at any time, and we may limit or stop the service, or any part of it, without notice. Group rooms and their votes are temporary and are deleted after a period of inactivity; anything saved on your device (such as My brackets) depends on your browser, which may clear it. Keep a share link of anything you want to keep.
Your content
Bracket titles, choices and names you enter are your content, and you're responsible for it. You keep any rights you have in it. You give us a worldwide, free license to store, display and process it only as needed to run BracketTap for you and the people you share it with (for example, showing your choices to voters in your room). We don't make private brackets public. Public brackets in Discover are written and curated by the BracketTap team.
Keep it family friendly
BracketTap is for everyone. Don't use it to post or share content that is violent or threatening, encourages self-harm, is hateful or harassing, is sexually explicit, is illegal, infringes someone else's rights (such as copyright, trademark or privacy), or shares other people's personal information. Our automatic filter blocks or masks some words; it isn't perfect, and getting around it is against these terms. We may remove content, close rooms, or block access for anyone who breaks these rules.
Don't misuse the service
Don't interfere with BracketTap or other people's use of it: no attempts to break into rooms you weren't invited to, vote more than once by getting around our limits, flood rooms or servers, scrape the site in bulk, reverse engineer or attack it, or use bots to manipulate results. Don't use BracketTap to send spam or to mislead people about who you are.
Hosts and streamers
If you host a room or show BracketTap on a stream or TV, you're responsible for your room, its brackets and how you present them, including your stream platform's rules. Results reflect votes from whoever joined your room; BracketTap doesn't verify voters, so don't use it for anything where the outcome must be secure, official or legally binding, such as elections, contests with prizes, or gambling.
Ads and sponsors
Some pages show sponsor messages or ads from Google AdSense, as described in our Privacy Policy. Sponsors and advertisers are responsible for their own ads, websites, products and offers. Links to other sites are provided for convenience; we don't control or endorse them.
Our name and site
BracketTap's name, logo, design, code and Discover brackets belong to us or our licensors. You may share links to BracketTap and show it on a stream or screen while you use it, but don't copy the site, use our name or logo in a way that suggests we endorse you, or build a competing service from our content.
Copyright complaints
If you believe something on BracketTap infringes your copyright, email support@brackettap.com with the page address, the material, your contact details and a statement that you own the rights. We'll review it and remove material where appropriate.
No warranty
BracketTap is provided "as is" and "as available", for fun. To the fullest extent the law allows, we make no promises that it will be uninterrupted, error free or secure, that results or crowd totals are accurate, or that anything will be saved. Some places don't allow these exclusions, so they may not all apply to you.
Limitation of liability
To the fullest extent the law allows, Oso Innovative, LLC and its owners, employees and partners aren't liable for any indirect, incidental, special, consequential or punitive damages, or for lost data, profits or goodwill, arising from your use of BracketTap. Our total liability for any claim about BracketTap is limited to US $50. Nothing in these terms limits liability that can't be limited by law.
Your responsibility
If your content or your misuse of BracketTap leads to a claim against us, you agree to cover the reasonable costs of that claim, to the extent the law allows.
Ending things
You can stop using BracketTap at any time. We may suspend or end your access, close rooms or remove content if you break these terms or to protect BracketTap or others. Sections that by their nature should continue (such as your content license for rooms already shared, no warranty, limitation of liability and governing law) survive.
Governing law
These terms are governed by the laws of the State of Texas, USA, without regard to its conflict of law rules, and disputes will be heard in the state or federal courts located in Texas, unless the law where you live gives you the right to bring a claim in your local courts. If you're a consumer in the EU, UK or elsewhere, you keep the protections of your local consumer law.
Changes
We may update these terms. When we do, we'll change the date below. Using BracketTap after an update means you accept the new terms. If any part of these terms can't be enforced, the rest still applies.
